Terms of Service

Welcome to TrashGeek (trashgeek.app), a cloud-based SaaS platform for dumpster rental dispatch management operated by REINERS.IO ("Company," "we," "us," or "our"). By accessing or using the TrashGeek platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
1. Acceptance of Terms
By creating an account, accessing, or using TrashGeek, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and REINERS.IO.
If you are using the Service on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms, in which case "you" refers to that entity.
2. Description of Service
TrashGeek is a cloud-based software-as-a-service (SaaS) platform designed for dumpster rental companies. The Service provides tools for:
- Managing dumpster inventory and fleet tracking
- Dispatching and scheduling rental deliveries and pickups
- Processing quotes, rentals, and invoicing
- Collecting payments via integrated Stripe Connect
- Sending SMS notifications to customers and drivers
- Route optimization and GPS-based trip tracking
- Embeddable quote request widgets for your website
- Reporting, analytics, and calendar synchronization
3. Account Registration and Company Responsibility
To use the Service, you must register an account and provide accurate, complete information. Each account is associated with a company entity within the platform. You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activity that occurs under your account
- Ensuring that all users you invite to your company account comply with these Terms
- Keeping your account information current and accurate
You must notify us immediately of any unauthorized use of your account or any other security breach.
4. Subscription Plans and Billing
TrashGeek offers the following subscription tiers:

Subscription fees are billed monthly in advance. All fees are non-refundable except as required by applicable law. We reserve the right to change pricing with 30 days advance notice.
5. Platform Fees on Stripe Connect Payments
When you collect payments from your customers through the integrated Stripe Connect functionality, TrashGeek applies a platform fee on each transaction. Platform fees are tiered by plan:

Platform fees are in addition to any fees charged by Stripe directly. You are responsible for understanding Stripe's own fee schedule.
6. User Roles and Data Isolation
TrashGeek is a multi-tenant platform. Each company's data is fully isolated from other companies. Within a company, user roles (owner, admin, dispatcher, driver) determine access levels. Company owners are responsible for managing their users and assigning appropriate roles.
Data access is scoped to your company via authenticated, JWT-secured API requests. You cannot access another company's data, and no other company can access yours.
7. Acceptable Use Policy
You agree not to use the Service to:
- Violate any applicable local, state, national, or international law or regulation
- Transmit any material that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
- Attempt to gain unauthorized access to any part of the Service, other accounts, computer systems, or networks
- Interfere with or disrupt the Service or servers or networks connected to the Service
- Use the Service to send unsolicited communications (spam) via SMS or other channels
- Reverse engineer, decompile, or disassemble any aspect of the Service
- Use automated systems (bots, scrapers) to access the Service without our written consent
- Resell or redistribute the Service without authorization
8. Data Ownership
You retain all ownership rights to the data you and your users input into the Service ("Your Data"). TrashGeek does not claim ownership of Your Data. We process Your Data solely to provide and improve the Service as described in our Privacy Policy.
You grant TrashGeek a limited, non-exclusive license to use, store, and process Your Data as necessary to operate the Service. Upon termination of your account, you may request an export of Your Data within 30 days.
9. Intellectual Property
The Service, including all software, designs, text, graphics, interfaces, and underlying technology, is the property of REINERS.IO and is protected by intellectual property laws. You are granted a limited, non-transferable, non-exclusive license to use the Service for your internal business purposes during your subscription term.
The TrashGeek name, logo, and all related trademarks are the property of REINERS.IO. You may not use our trademarks without prior written consent.
10. Third-Party Integrations
The Service integrates with third-party platforms including, but not limited to:
- Stripe - payment processing via Stripe Connect
- Twilio - SMS notifications and alerts
- QuickBooks - accounting synchronization
- Xero - accounting synchronization
- Invoice Ninja - self-hosted accounting synchronization
Your use of these third-party services is governed by their respective terms of service and privacy policies. TrashGeek is not responsible or liable for any issues, outages, data loss, or damages arising from your use of third-party integrations. We do not guarantee the continued availability of any third-party integration.
11. SMS Notifications Consent
The Service uses Twilio to send SMS notifications, including but not limited to delivery confirmations, pickup reminders, driver alerts, and dispatch notifications. By using the Service and enabling SMS features, you consent to receiving these communications and represent that you have obtained appropriate consent from your customers before sending them SMS messages through the platform.
You are solely responsible for compliance with the Telephone Consumer Protection Act (TCPA) and all other applicable telecommunications laws when using the SMS functionality.
12. Termination and Suspension
You may cancel your account at any time through the platform settings or by contacting us at sales@trashgeek.app.
We may suspend or terminate your account at any time if:
- You violate these Terms or our Acceptable Use Policy
- Your account is used for fraudulent or illegal activities
- You fail to pay applicable fees
- Continued provision of the Service to you is not commercially viable
Upon termination, your right to use the Service ceases immediately. We may retain Your Data for up to 30 days following termination to facilitate data export, after which it may be permanently deleted.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, REINERS.IO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
14. Indemnification
You agree to indemnify, defend, and hold harmless REINERS.IO, its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Service
- Your violation of these Terms
- Your violation of any applicable law or regulation
- Any data or content you submit to the Service
- Your SMS communications sent through the platform
15. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide at least 30 days advance notice of material changes by email or through the Service. Your continued use of the Service after the effective date of the revised Terms constitutes acceptance of the changes.
We encourage you to review these Terms periodically for updates.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of South Dakota, United States of America, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in South Dakota.
